General conditions of sale

The following general conditions aim to define the legal framework which will apply in the relations between:

- the company Sunnyland Créations, owner of the Têtes Blondes brand, which publishes the website www.tetesblondes.com,
- and any person visiting or making a purchase on the website www.tetesblondes.com

Their purpose is to define the reciprocal rights and obligations of the two parties in the different stages of ordering one or more items.
Any person registering on the site must adhere to these general conditions of sale and thus accept them without reservation.
No purchase may be made on the site without first accepting these terms and conditions. The user may consult the general terms and conditions of sale at any time by clicking on the "General Terms and Conditions of Sale" section at the bottom of the screen.

These conditions express the entirety of the obligations of the parties.

If a condition were to be missing, it would be considered to be governed by the practices in force in the distance selling sector.
If a particular provision of these conditions is held to be invalid or declared as such by a decision having the force of res judicata of a competent court (change of legislation, regulation, court decision), the other provisions would retain their full force and scope.

Customer limitation

The items displayed on the site are only offered for sale to non-commercial individuals.

Any user of the site declares that they have the legal capacity to place an order on the site and to use a bank card.

Article 1: Products and availability

The website tetesblondes.com offers jewelry and fashion accessories for sale.
The products sold are photographed and described as faithfully and accurately as possible. However, errors or omissions are possible.
Likewise, depending on the internet browser or screen used, the colors of the items may not correspond to the actual colors.
The illustration photos used on our site come from our own shootings.

Article 2: Order

Orders are accepted exclusively online after acceptance of these general terms and conditions of sale. To place an order, visit the website www.tetesblondes.com.
Order data is stored on reliable and durable computer media. It is considered proof of the contractual relationship between the parties in the same way as any document established, received, or kept in writing. Refer to our privacy policy.

Article 3: Payment and security

On the website www.tetesblondes.com, payment for purchases is made when ordering either by credit card, Paypal or Alma (payment in 3 installments without fees)

Payments by credit card and Paypal are collected upon ordering.
Cards bearing the “CB” symbol and/or bearing the VISA, EuroCard or MasterCard brand accepted in France and e-bank cards can be used.

Article 4: Price

Prices displayed on the website are in euros, inclusive of all French taxes (French VAT and other taxes applicable on the day of the order) excluding processing and shipping costs. Delivery costs are indicated before the order is confirmed.
Promotional codes cannot be combined with each other; one code can only be used for one order.

Article 5: Delivery

5.1 How are the items delivered?

Parcel delivery is carried out according to the possibilities and your choices by La Poste in "Letter suivi", "Colissimo suivi" against signature of the recipient or any person specially authorized or by Mondial Relay, Colissimo Relais and Chronopost Relais. For tracked letters, the flashing of the postman when depositing in the mailbox is proof of delivery of the order to the customer. Digitized signatures as well as their reproductions are proof of delivery of the parcels for other carriers.

5.2 Delivery Problems

If the buyer notices a break-in or damage to their package, they have three days to notify the seller. We advise you, if the original packaging is damaged, torn, or open at the time of delivery, to check the condition of the items in the presence of the delivery person and to immediately make reservations on the delivery slip, or even to refuse the package.
It is the buyer's responsibility to determine whether their package has been tampered with or damaged. We recommend that you systematically check the contents of the package in the presence of the carrier, in order to verify the condition of the items, even if your package shows no signs of deterioration. If they have been damaged or stolen, you must refuse the package and note a reservation on the delivery slip (package refused because open or damaged). Têtes Blondes / SUNNYLAND CREATIONS cannot be held liable if the buyer has not made a reservation.
To obtain a refund or exchange of items (while stocks last), the buyer must inform us of any problem they have noticed by sending us a message via the "Contact" section. They must provide a detailed description of the problem they have noticed (e.g. damaged package, already opened, etc.). The buyer may be asked to provide a photo of the damage by email.
If the package is not delivered by the Post Office, the buyer must inform Têtes Blondes via the "Contact" section. We will then open an investigation with the relevant services. You will receive an email indicating that an investigation has been opened. The Post Office's final response time varies from 2 to 4 weeks. If the package is found, it will be sent to the customer according to the usual procedure. If the package is declared lost and there is no more stock available to ensure a second shipment, the order will be refunded as soon as possible.

Article 6: Right of withdrawal and return of products

RETURN POLICY

All products sold on the site are exchangeable and refundable.

To be eligible for a refund, items must be returned in their original packaging and unworn. Any items received that do not meet these conditions will not be accepted and will be returned to you.

Defective items

Products are considered defective if they are damaged upon receipt or if a manufacturing defect is found within six months of the purchase date. If your item is received defective or you wish to make a reservation (damaged package, open package, missing product, damaged or soiled product, etc.) you must notify us upon receipt of the package in the "contact" section.
Then request a return of merchandise in your account and return the defective item within 14 days from the date of receipt of your order. Please note that items damaged as a result of normal use will not be considered defective.

Colors

We make every effort to display the colors of the items offered on Têtes Blondes as accurately as possible. However, the resolution of computer, tablet, and smartphone screens varies from one device to another, so we cannot guarantee 100% display of actual colors.

Article 7: Liability

The products offered comply with current French legislation and the standards applicable in France. Consequently, Têtes Blondes cannot be held liable for any errors or omissions in any of these photographs, texts, graphics, information, or product characteristics. Article 8: Intellectual and industrial property

All texts, comments, works, illustrations and images reproduced on the site published by Têtes Blondes are reserved under copyright and intellectual property law and for the entire world.
As such and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code. Any other use constitutes infringement and is punishable under Intellectual Property law unless prior authorization is obtained from Têtes Blondes.
The trademark and logo appearing on the têtes blondes.com website are registered with the INPI (French Intellectual Property Office) under number 12 3 901 243 and are protected. Any total or partial reproduction of these trademarks and/or logos, made from elements of the site without the express authorization of Têtes Blondes, constitutes an offense of counterfeiting punishable by Articles L.335-2 et seq. of the Intellectual Property Code.

Têtes Blondes undertakes not to disclose to third parties the personal information you provide to us. This information is confidential. It will only be used by its internal services to process your order and to strengthen and personalize the communication and product offering reserved for Têtes Blondes customers, in particular through the tetesblondes.com newsletter. This article shall not prevent the assignment or transfer of activities to a third party.

All our products benefit from:

- the legal guarantee of conformity
- the legal guarantee of hidden defects.
To benefit from the product warranty, it is essential to keep the product purchase invoice.
Contractual guarantees do not cover:
- abnormal or non-compliant use of the products. In this regard, we invite you to carefully consult the maintenance instructions,
- defects and their consequences linked to use not in accordance with the use for which the product is intended,
- defects and their consequences linked to any external cause.

After-sales service

For all “after-sales service” requests, please allow 21 days excluding weekends for the collection and repair of the jewelry.
For any inquiries, please contact the store where your jewelry was purchased or in the contact section if the purchase was made on the website.

Article 12: Disputes

Any dispute resolution may be made through our customer service department and, in the absence of an amicable settlement, the rules of jurisdiction will apply. However, the website www.tetesblondes.com reserves the right to sue the customer before the court in the jurisdiction of their domicile or registered office.

Article 13: Non-waiver

It is agreed between Têtes Blondes and the users of the site that any failure or waiver by one of the parties in the application of all or part of the commitments provided for in these general conditions of sale cannot constitute a modification of this agreement, nor generate any right whatsoever, nor even be interpreted for the future as a waiver of the commitment in question.
